The General Terms and Conditions of Sale exclusively regulate the offer, transmission, acceptance, shipment, purchase methods and right of withdrawal of purchase orders of products on the site between purchasers and the company La Fornase Srl. The matter is regulated, at least within the European Union, by Regulation 593/2008, which provides that the contract is governed by the law chosen by parties. The parties may designate the law applicable to the whole contract or only to a part of it. The parties may agree at any time to subject the contract to a different law. If the law chosen is that of a country other than the one with which the contract is most closely connected, the provisions of the latter law must be observed. If the contract relates to one or more member States, the applicable law chosen, other than that of a member State, must not be in contradiction with the provisions of Union law. The law applicable to the contract is the law freely chosen by the parties. The choice of the applicable law is normally followed by the identification of the court competent to judge disputes. In the case of e-commerce, however, it is also necessary to bear in mind the provisions of the Consumer Code (D.Lgs n.206/2005) , which deems it an unfair term to establish a judicial venue for any disputes other than the consumer’s place of domicile or residence. It is therefore necessary and of paramount importance that this is expressly regulated in the terms and conditions of sale on the e-commerce site in order to avoid disputes. Please not that the provision of services or the sale of products by other parties present on the site via hyperlinks, links or banners is not regulated.

Acceptance of the sale

The sales contract between the customer and La Fornase Srl is concluded with the acceptance of the order by La Fornase Srl. Acceptance in considerate tacit unless otherwise communicated by the customer in writing. The customer declares to have read the sales instructions described and to accept them.

Damaged products

In case of receipt of damaged goods, you must return the damaged parcel to the sender, we will then ship a new delivery.

Right of cancellation

The right of cancellation in e-commerce may be exercised within a period of 14 days, which shall be counted as follows: in sales contracts, from the day on which the consumer or a third party designated by him to receive the goods takes physical possession of them.
In order to exercise the right of cancellation, the consumer must inform the seller of his decision within 14 days, by means of the appropriate form or by other written communication to be sent to the company e-mail address. Cancellation releases the consumer from his contractual obligations. The consumer is obliged to return the goods and the trader is obliged to refund the payment received. the consumer is obliged to return the goods received, without undue delay and within 14 days from the date on which he communicated his decision to exercise the right of cancellation to the trader. The costs of return shall be borne by the consumer, unless otherwise agreed and provided that the consumer has been informed of such costs prior to the conclusion of the contract. The trader shall reimburse the payment received within 14 days of being informed of the consumer’s decision to exercise this right. It may, however, withhold the refund until it has received the goods or until the consumer proves that the goods have been shipped. Costs incurred for the initial shipment of the goods, from the trader to the consumer, must also be refunded if the consumer has chosen the cheapest mode of shipment among those offered by the trader. Where, on the other hand, the consumer has chosen a type of delivery that provides for higher costs than the cheapest offered by the professional, the shipping costs will remain at his or her expense, unless otherwise provided for in the contract. reimbursement must be made using the same means of payment used by the consumer for the initial transaction, unless otherwise expressly agreed between the parties.

Shipping costs are free for orders over €99 with delivery in Italy. For orders under 99€ are charged to the customer.
